TempWorks Software Launches Intellectual Property Suit Against Software Vendor Avionte
St. Paul, MN (PRWEB) October 8, 2008 -- TempWorks Software, a provider of staffing software and business service solutions for the staffing and human resource industries, today announced the initiation of an intellectual property lawsuit against competitor Avionte, LLC (case number 08CV5330 DWF/JSM - jurisdiction is Federal District Court, District of Minnesota).
The suit, filed Friday, October 3rd in federal court, alleges that Avionte has pirated significant elements of TempWorks source code and database design and made use of proprietary TempWorks marketing materials. The complaint further alleges that TempWorks has sustained losses of revenue and marketplace good-will due to these actions. This lawsuit comes after months of deliberation and investigation by TempWorks Software in cooperation with representatives of law-firm Dorsey & Whitney and Special Agent Robert Cameron of the Minneapolis office of the FBI.
The complaint lists as the defendant Avionte, LLC, whose principals were employed by TempWorks Software between 1997 and 2006. The complaint seeks recovery of punitive damages suffered by TempWorks over the past year, and seeks injunctive relief restraining the defendant and its employees or representatives from selling, marketing, modifying or accessing any source code derived from TempWorks' intellectual property.
TempWorks announced these proceedings at an internal staff meeting the morning of Monday, October 6th. "When my father wrote the ancestor programs from which the current TempWorks database evolved, his vision was to remove the stress and disorganization which he felt crippled his former employer and turn his newly minted Manpower franchise into a technological innovator and a role model for other firms in our market," remarks TempWorks founder and CEO Gregg Dourgarian. "It's only fair to those who have invested in a career or a business relationship with TempWorks that we confront in a court of law those who might attempt to plagiarize years of our hard work," continues Dourgarian.
The lawsuit is the first of its kind in the rapidly expanding sector of temporary staffing software. "The most challenging aspect of this situation is balancing the need to have our arguments heard before a court in an expedient manner against the fallout that this type of action might have on our organization's reputation in the marketplace," remarks TempWorks President David Dourgarian. "We're highly sensitive to the stress that this legal action will cause to current Avionte customers and we need to be extremely careful to communicate to these organizations and the staffing industry at large that we care only to resolve the twin issues of slander and copyright infringement."
